For the government to  prove a charge of embezzlement, the government  must first show that there was a fiduciary relationship between defendant and victim.

Secondly the defendant must have taken the property in question with that of the  fiduciary relationship.  The government must also  prove that the defendant took ownership of the property with an intentional act.

Most embezzlement cases occur with accountants or money managers.
